Civil Rights

Civil Rights matters are complex cases that require representation by a top trial lawyer.  Let Charles stand with you and assure your rights are protected.

Charles E. Cox, Jr. represents individuals who have had their constitutional or federal statutory rights violated by a state or local official. A Section 1983 lawsuit allows individuals to recover damages resulting from the violation of their rights, including physical, mental, and emotional injuries, as well as punitive damages and attorney’s fees in certain cases. Most Section 1983 lawsuits involve:

  • The use of excessive force by law enforcement officers;
  • False arrests by law enforcement officers and malicious prosecutions when the officer does not have probable cause of criminal conduct;
  • Jailers or guards beating or injuring inmates, or being deliberately indifferent to their medical needs;
  • First Amendment cases in which the government prohibits you from engaging in protected speech or retaliates against you for engaging in protected speech.

In addition, Charles represents public employees in claims under the Georgia Whistleblower Protection Act (O.C.G.A. section 45-1-4(d)). This Act prohibits public employers from retaliating or discriminating against you for revealing or reporting a violation of or non-compliance with a law, regulation, or rule to a government agency or supervisor.
